3.4 No Obligation

Receiving an estimate does not obligate you to hire Erazo's Painting LLC, nor does it obligate us to perform the work. A binding agreement is created only when both parties sign a written contract.

4.1 Pricing

All prices are quoted in U.S. dollars. Final pricing will be detailed in a written contract before work begins. Prices may include labor, materials, permits, and disposal fees as specified in your contract.

4.2 Payment Terms

Payment terms will be specified in your contract. Typical payment structures include:

• Deposit upon contract signing (typically 10-30%)
• Progress payments based on project milestones
• Final payment upon project completion and client approval

4.3 Accepted Payment Methods

We accept the following payment methods:

4.4 Late Payments

Late payments may incur interest charges at a rate of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is less. We reserve the right to suspend work on projects with overdue balances.

By allowing us to perform work on your property, you grant us a non-exclusive, royalty-free license to photograph the completed work and use such photos for marketing, portfolio, and promotional purposes. You may request in writing that we not use photos of your specific property.

"Erazo's Painting LLC," our logo, and all related names, marks, and slogans are trademarks of Erazo's Painting LLC. You may not use our trademarks without our prior written consent.

7.1 Website Use

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Erazo's Painting LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, OUR SITE OR SERVICES.

7.2 Service Work

Our liability for service work is limited to the terms specified in your written contract. We maintain general liability insurance and workers' compensation coverage as required by North Carolina and South Carolina law.

7.3 Warranty

We provide warranties on our workmanship as specified in your contract. Material warranties are provided by the manufacturers and are subject to their terms and conditions. EXCEPT AS EXPRESSLY STATED IN YOUR CONTRACT OR THESE TERMS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.4 Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, weather conditions, natural disasters, pandemics, government actions, labor disputes, or supply chain disruptions.

You agree to indemnify, defend, and hold harmless Erazo's Painting LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, actions, demands, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

9.2 Termination by Us

We reserve the right to suspend or terminate your access to our Site and/or terminate any service agreement, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Failure to make payments when due
• Fraudulent or illegal activity
• Conduct that harms other users or third parties

9.3 Effect of Termination

Upon termination, your right to use our Site and services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Brunswick County, North Carolina.

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us. If the dispute cannot be resolved informally, we agree to submit the dispute to mediation before pursuing litigation.

10.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

10.4 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. The waiver of any such right or provision shall be effective only if in writing and signed by a duly authorized representative of Erazo's Painting LLC.

10.5 Entire Agreement
