3. Estimates and Quotes

4. Pricing and Payment

4.1 Pricing

All prices are quoted in U.S. dollars. Final pricing will be detailed in a written contract before work begins. Prices may include labor, materials, permits, and disposal fees as specified in your contract.

4.2 Payment Terms

Payment terms will be specified in your contract. Typical payment structures include:

  • Deposit upon contract signing (typically 10-30%)
  • Progress payments based on project milestones
  • Final payment upon project completion and client approval

4.3 Accepted Payment Methods

4.4 Late Payments

By allowing us to perform work on your property, you grant us a non-exclusive, royalty-free license to photograph the completed work and use such photos for marketing, portfolio, and promotional purposes. You may request in writing that we not use photos of your specific property.

"Erazo's Painting LLC," our logo, and all related names, marks, and slogans are trademarks of Erazo's Painting LLC. You may not use our trademarks without our prior written consent.

7. Limitation of Liability

7.1 Website Use

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Erazo's Painting LLC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, OUR SITE OR SERVICES.

7.2 Service Work

Our liability for service work is limited to the terms specified in your written contract. We maintain general liability insurance and workers' compensation coverage as required by North Carolina and South Carolina law.

7.3 Warranty

We provide warranties on our workmanship as specified in your contract. Material warranties are provided by the manufacturers and are subject to their terms and conditions. EXCEPT AS EXPRESSLY STATED IN YOUR CONTRACT OR THESE TERMS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.4 Force Majeure

We shall not be liable for any delay or failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, weather conditions, natural disasters, pandemics, government actions, labor disputes, or supply chain disruptions.

8. Indemnification

We reserve the right to suspend or terminate your access to our Site and/or terminate any service agreement, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms
  • Failure to make payments when due
  • Fraudulent or illegal activity
  • Conduct that harms other users or third parties

9.3 Effect of Termination

Upon termination, your right to use our Site and services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

In the event of a dispute, you agree to first attempt to resolve the matter informally by contacting us. If the dispute cannot be resolved informally, we agree to submit the dispute to mediation before pursuing litigation.

10.4 Waiver
